As a consequence of an injury Brain death can occur without actual clinical death. Life support systems can keep an accident victim’s body alive, even if there is basically no brain function at all.

The basic automatic functionality of the human brain will keep the heart beating and the lungs pumping even if the rest of the brain has been damaged beyond the point of no return.

Many families experience the tragedy of Brain Injury Death, where a family member who has been involved in an accident is constantly at the edge of life, with little or no prospect of passing to either side.

At such times the family’s cultural and religious beliefs may become involved in the decisions that need to be made regarding the manner in which the Brain Injury Death is dealt with. Some families choose to keep their loved one on Life Support, while they pray, and hope for a miracle.

Miracles do happen.

Other families will take a more pragmatic viewpoint, and take into consideration such factors as the time that has elapsed since the accident or the injury, emotional trauma, future costs, and then, in consultation with the medical practitioner sign a DNR, or “Do Not Resuscitate order”, thereby allowing the loved one to pass on.

Many people leave instructions to their families on the care they wish to receive in the event of an occurrence that may leave them Brain Dead. These instructions are in the form of a “Living Will” or “Life-care Directive” which forms a part of their Last Will and Testament. It is not unusual for a paragraph or two to be inserted in the Last Will and Testament regarding health care surrogacy or a power of attorney form.

The purpose of this web article is not to make comment about an individual's personal choices, but is intended to educate you about the possible paths of outcome and the legalities of end of life or near death due to brain injury choices.
